On next Monday, June 6 at 6:00 PM, the Shelby County Planning Commission will hear a request to change zoning of the 145-acre Eagle Point Golf Club property from R-5 Multi-Family District (apartments) and R-1 Single-Family District to R-2 Single-Family Special District. The rezoning is required for the development of a proposed master planned single-family subdivision currently named "Griffin Park at Eagle Point".

The Eagle Point Homeowners Association is officially supporting the Request for Rezoning Approval currently submitted by the owner Highpointe Investments LLC (Connor Farmer, et. al.) for review by the Shelby County Planning Commission. We view the proposal as the best option to protect Eagle Point and the greater community by eliminating zoning for apartments and complementing the existing neighborhood with a new planned single-family community.
Homeowners working with the HOA, the real estate attorney, real estate agents, and real estate consultants have unanimously agreed that our foremost priority is to protect Eagle Point and the greater community by eliminating the possibility of apartments in Eagle Point. Since the property is currently zoned R-5 Multi-Family District, an owner / developer is only required to complete an administrative review of the site plan for apartments. There are no requirements for a public hearing or a presentation before the Planning Commission. If the rezoning application is denied by the Planning Commission, an applicant must wait 12 months to re-apply or amend an application. Since it is known that all six other potential buyers offered to purchase this property for the sole purpose of developing apartments, allowing this property to remain zoned as R-5 Multi-Family District is not an acceptable option for Eagle Point.
Current R-5 Multi-Family zoning allows for approximately 377 apartment units to be built in the center of Eagle Point subdivision. Under such a scenario, these 377 apartments would located in unincorporated north Shelby County and zoned for Oak Mountain Elementary, Oak Mountain Intermediate, Oak Mountain Middle, and Oak Mountain High Schools.

It is unlikely there will be a second chance, since a denial of this application would require 12 months before another application. Rezoning of Golf Course:
Thank you to the homeowners who contacted the Homeowners Association and the County with comments before the Shelby County Planning Commission meeting held on June 6. Thank you to those Eagle Point homeowners and concerned homeowners from surrounding neighborhoods who got engaged and attended the critical meeting and vote. The proceedings and outcomes of the June 6 meeting are summarized in the following excerpt from 280 Living (Erica Techo, June 7, 2016):
At the June 6 Shelby County Planning Commission meeting, all present commissioners approved a request to rezone the 144.02-acre property from R-5 Multiple Dwelling District and R-1 Single Family District to R-2 SD, Single Family Special District. Commissioner Amy Smith was absent. The request to rezone the property was submitted by Connor Farmer with Highpointe Investments LLC, who said he was approached by a broker when the owners of the golf course chose to put the property up for sale.
Ripon Britton, an attorney representing the HOA, spoke in support of the rezoning request. When news that the golf course was being sold got out a few months ago, Britton said there was concern in the neighborhood regarding the loss of a central feature of the development. At that time, the HOA put together a committee to work on a plan and open communication with Farmer regarding the property.
Several meetings with Farmer and representatives from Shelby County followed, Britton said, and worked out a memorandum of understanding to meet and address homeowner concerns.
“Obviously as with anything of this nature, there was some give and take between the developer and the homeowners association,” Britton said.
In the memorandum of agreement, Farmer and the homeowners association agreed he would use best efforts to enter the development via the U.S. 280 and to work to avoid the Lee Branch area and potential congestion, to have considerate building practices and limit activity to the daytime, to keep roads and lakes clean of dirt and debris and to repair and maintain all common areas (including roads, signs, shrubs, etc.).
The agreement also included a request for a 20-foot buffer and a berm with natural plantings to be built between the former golf course property and adjacent, existing home lots.
“Based on that agreement, Mr. Chairman, the homeowners association is in support of this,” Britton said. “They would love a golf course, but they definitely do not want the apartments.”
Thanks to everyone who has participated in this difficult process, including those who attended town hall meetings, those who emailed and called the HOA, and the 230 homeowners who responded to the survey, and especially to Tim O’Dell, Michael Riosa, and Tim Page who spent countless hours researching, documenting, and publicizing information to the neighborhood. Thank you to the ten volunteers who hand-delivered packets to the 700 homes in Eagle Point. All relevant information which has been documented on the EPHOA.org website, survey results, and a letter of support from your HOA board were shared with the Shelby County Planning Services division and the Planning Commission.
We understand that not everyone in the neighborhood is pleased with the new development and we appreciate the homeowners who spoke about special concerns. We agree that those issues are important, and the Board and committee will be monitoring construction and the process and we are determined to hold the developer and the builders accountable for the promises they have made.
HOA Structure. The next task of the HOA is for the neighborhood to discuss and decide if the Eagle Point HOA should incorporate the homes in Griffin Park at Eagle Point, if they should form a new HOA that is a sub-association of EPHOA, or if it will be a completely independent association. We will be communication details of these possible scenarios and plan to host a Town Hall Meeting soon to discuss these issues with the entire neighborhood. As the weather turns warm and we are working in our yards and doing home repair and improvement please be mindful of your neighbors and the Neighborhood Covenants. Yards look good and we are pleased that Eagle Point homeowners take pride in their homes, but there are too many trash bags and debris left in driveways and on the curbs. WastePro picks up trash on Tuesdays. Please do not leave things out all week for pickup; instead place them out on Monday afternoon or evening. Keeping the neighborhood neat and attractive will help us hold Highpointe and their builders accountable for any untidiness caused during development and construction in the new subdivision. It is more difficult to expect them to do their part if we do not show responsibility, pride, and respect for our community. This is especially true for trailers, blocked roadways, unkempt lawns, and trash and debris. We also must remember that as construction begins it is very important to keep the storm drains clear; please do not blow grass clippings into the storm drains. Please remind your yard service companies of this as well.
Good Neighbor Process:
To help maintain the appearance of Eagle Point your HOA will send good neighbor reminder letters to homeowners who may have neglected to take care of the trash or debris (or other covenant violations). If a second letter is required it will give the homeowner 5-10 days (depending on the issue) to resolve the problem. The second letter will also state that if the homeowner does not respond or comply your HOA will remedy the issue and bill the homeowner.
Eagle Point Swim & Tennis Club
The HOA office has received several calls about Eagle Point Swim & Tennis Club. The Swim and Tennis organization is independent from the HOA.
